BOOKING TERMS & CONDITIONS

Please read the Terms, Conditions & General Information contained in these pages very carefully. They outline the terms under which your tour will operate and they limit our liability. Payment of deposit and/or final payment an acknowledgment of receipt of these terms & conditions and constitutes acceptance of such as outlined.

RESERVATIONS, DEPOSITS & PAYMENTS

Your travel arrangements should be made well in advance, especially if you are traveling between October- March (high tourist season) and May- June, the Indian holiday season. Travel facilities are limited in relation to demand so prior bookings are a must. The carefully selected unusual programs / places being sent to you tend to sell out fast. As such, early reservations are essential to ensure availability of space.

An advance payment of 50% of the total Tour Cost will be due to “The Luxury Holidays” when we have confirmed the tour related services to you. However, we shall not need any advance at the time of making the reservations. If deposit is not received at our offices within 10 days from the date of reservations, booking/s is/are subject to cancellation.

Final payment is due to “The Luxury Holidays” 45 days prior to departure date (Some Tours may require final payment 60 Days prior).

If the reservation is made within the last 40 days of departure (and if space is still available), the entire tour price must be paid after our confirming the tour to you in written.

All the payments have to be made in favor of “The Luxury Holidays”

VALIDITY OF TOURS / COSTS

(1) All the “Tour Costs” are valid from Oct 01, 2011 to March 31, 2012 unless otherwise specified except for the periods

(2) Christmas and New Year Period: December 20, 2010 – January 04, 2011  

(3) There will be a Supplement of 15% on hotels all over India for this period. There will also be an additional charge for Compulsory “Christmas & New Year's Eve Dinner and other included activities” and have to be paid directly to the hotels during the stay by the guests.

PRICES, RATES & AIR FARES
Unless otherwise indicated, all price rates shown are in United States Dollars and are per person sharing a double-bedded hotel room. These prices are are subject to change at any time prior to departure.

Quoted tour prices are based on current rates of exchange.

“The Luxury Holidays” reserves the right to increase tour prices to cover unavoidable sudden increased costs of tariffs, taxes, park fees and fluctuations in foreign exchange markets as per directives from hotels / government taxation department / Park Authorities etc .
Excellent fares, matching the tour (for the places to be routed by air as per the Itinerary) are available upon request at the time of booking. However, the special fares are non-refundable and also carry a surcharge on date change or any cancellation.

TRAVEL DOCUMENTS
All the foreigners who wish to visit India for any purpose require valid Visa which is issued by the Government of India or the Indian Consulates situated in their countries for the specific purpose as mentioned by the applicants.

But before the issuance of Visa, visitors must possess the valid passport issued by the Governments of their respective countries from where they belong to as Citizens. All the tourists must be in possession of a passport valid for 6 months beyond the re-entry date into their country.

Make sure to carry attested photocopies of your travel documents and keep the originals in a safely locked baggage.

It is always passenger’s responsibility to ensure that all his or her visa and passport requirements are met.

TOUR INFORMATION
Acknowledgment of booking will be sent immediately upon initiation of a reservation. Invoice and general information such as reading and clothing suggestions, customs information, anticipated weather conditions, etc. will be forwarded to you upon receipt of deposit, if desired.

The infrastructural details, amenities, hospitality services, transport, with in India flights etc. are all subject to availability at the time of making the reservations.
Final tour documents consisting of detailed tour itinerary, vouchers, hotel list etc., are handed over on arrival in India. If documents are required / requested for in advance, a handling fee of US$25 will apply to cover handling, early processing and courier charges.

The information and facts made available to you in the programs being sent to you have been compiled for helping you or your esteemed guests in deciding your preferences for the various tour itineraries and charting out the required tour structure. All the information has been provided to the best of our knowledge and extensively checked by travel experts.

Our whole hearted attempts at giving you the very best never cease, but that not withstanding at times circumstances get out of hand and we have to deviate from what is mentioned in the sent details. It will happen only because we are here to fulfill our promises of providing you with the best in travel entertainment.
The mentioned hotels might not be available some times of the year due to advance bookings, renovation / repair work or other such reasons, in which case we shall have to make necessary changes to suit your itineraries.

Nevertheless, any change or modifications in the tour schedule will be intimated to you at the time of booking or confirmation. What goes unsaid, are the incessant attempts from our end to make your tour worthwhile and you can be rest assured that our experienced team members are always there to show you the best face of India.

CANCELLATIONS & CHANGES

Because of the special nature of the featured programs, suppliers impose rigid cancellation fees and please take note that “The Luxury Holidays” has no control over such fees and cannot make any exceptions to these charges.

Note: All cancellations must be received by us in writing; cancellation/s will be effective when the written notice is received at our office on weekdays.
Amount of Cancellation Charge has been shown below:

More than 60 days  No Cancellation
30 – 60 days 10% of the total Tour cost
15 – 30 days 25% of the total Tour cost
7 – 15 Days 50% of the total Tour cost
72 hours – 7 Days 75% of the total Tour cost
Within 72 Hours 100% of the total Tour cost

Airfares, if offered are subject to different rules and cancellation fees; some may be non-refundable. Details will be provided at the time of booking. To protect against cancellation charges, we strongly recommend purchasing Cancellation Protection and Travel Interruption Insurance.
We at “The Luxury Holidays” cannot be held responsible for any change/cancellation penalties associated with non-refundable airfares.

UNUSED TOUR ITEMS

No refund will be made for any unused accommodations, missed meals, transportation segments, cruise portions, sightseeing tours or any other service. Such unused items are neither refundable nor exchangeable (no exceptions) as they are always prepaid.

HEALTH REQUIREMENTS

Health regulations for some places/ countries visited on featured tours may require proof of inoculation and / or vaccination certificate; such certificate should be in your possession throughout the entire tour. WE strongly recommend that you consult with your personal physician before embarking on the tour.

CHANGE IN RESERVATIONS (CRUISE AND RAIL TERMS)

If you wish to change any item or a change of date / itinerary other than increasing the number of persons in the tour and providing the change is feasible, changes must be confirmed to us in writing. The changes would totally depend on availability and feasibility and you would be updated accordingly.
However, we wish to clarify that last minute changes in program or hotels will not be possible and the tourists will have to take the tour as per the confirmed itinerary. 
The changes in dates or in the itinerary within 15 days of scheduled departure will be treated as a canceled tour and fresh bookings will be initiated. 

CRUISE AND RAIL JOURNEYS

Deviations to the planned cruise or rail itineraries are possible, although every effort will be made to keep them as they are shown. All cruise or rail routes are subject to change without notice. Should conditions render cruise or rail routes unsafe for navigation, alternative services may apply, including but not limited to, accommodation on the docked ship (for cruise itineraries) and/or substitute hotels/ ground arrangements.

YOUR TOUR PRICE INCLUDES

Accommodations
Accommodations on a single/ double occupancy basis, will be provided at the property / hotel specified or similar as per requirements. Rooms will be assigned by the respective supplier/s on a run-of-the-house basis, in category/ies as specified in the itinerary.
The hotels featured in the itinerary will be in accordance to the level of the program – First Class, Deluxe or Luxury - (this term may be defined by the hospitality industry in the region providing such accommodation or by hotel trade custom). All per person rates are based on double occupancy of the respective accommodation units as described in the Tour Cost. A Tour member occupying a single room, either by choice or by circumstance, is required to pay the single room supplement. Quoted single room rate does not necessarily mean single occupancy of a double room.

Meals

Meals plan for each tour are clearly stated in “Tour Inclusions” portion of the offer sent to you. A la Carte, Buffet meals and/or table d’hôte are offered. Special meals and entertainment are included where ever shown in the itinerary only. In some rare instances, a meal may not be of a standard expected under the term of “Deluxe” particularly in remote areas.

Sightseeing & Land Tour Services
The following services are included in your tour price: transportation between the airports and hotels only in India, sightseeing with local English-speaking guides / Language guides as mentioned in the itinerary and all entrance fees to attractions visited as described in the itinerary.

Sightseeing will be via motor coach, private car and other modes of transportation (air conditioned where necessary and available), as determined by the nature of the terrain and as outlined in the itinerary. Transfers are not included when arriving or departing at the first destination gateway by means other than the scheduled tour flights, but can be arranged at additional cost.

Special Entertainment
Cultural entertainment events, gala evenings and/or festivals which have been specified in the itinerary are included.

TOUR PRICE EXCLUSIONS

Your tour price does not include: Air transportation (unless specifically stated as included); costs and fees to obtain or extend your passport/s; visa fees and processing fees; inoculations and vaccinations (if required); health certificate; airport taxes and country departure taxes (if applicable); all items of a personal nature including alcoholic beverages (except on certain occasions): meals not specified, baggage handling, tips to tour guides; excess baggage charges; cancellation, health, accident and baggage insurance; private, non-group transfers; and any items not specifically listed as included.

RESPONSIBILITY– LIMITATION OF LIABILITY

“The Luxury Holidays” act only in the capacity as an agent for the hotels, airlines, bus companies, railroads, ship lines, and/or contractors providing accommodations, transportation or other tour related services to the client. The client is advised that we also purchase such transportation, hotel accommodations, restaurants and other services from various independent suppliers who are not affiliated with us.

We make every effort to select the best suppliers of the aforementioned services. However, we do not control the operations of these agents and as a result, CANNOT BE HELD LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE OR OTHER CLAIM which may occur as the result of any and/ or all of the following:

(1) The wrongful, negligent or arbitrary acts or omissions on the part of the independent supplier, agent, its employees or others who are not under the direct control or supervision of “The Luxury Holidays”

(2) Defects or failures of any vessel, aircraft, vehicle or other instrumentality which is under the control of an independent supplier; or

(3) Loss, injury or damage to person, property or otherwise, resulting directly or indirectly from any Acts of God, dangers, incidents at sea, fire, breakdown in machinery or equipment, or wars (whether declared or not), hostilities, civil disturbances, strikes, riots, thefts, pilferage, medical epidemics, quarantines, or customs regulations, defaults, delays or cancellations or alterations in itinerary due to schedule changes, or from any causes beyond our control.

Further, we are not liable for any loss or damage resulting from insufficient or improperly issued passports, visas or other legal documents. All coupons, exchange orders, receipts, contracts and tickets issued by us are issued subject to any and all tariffs, terms, and conditions under which any services are provided by such hotels, airlines, bus companies, railroads, ship lines or owners or contractors or by their person in employ.

RESERVATION OF RIGHTS
“The Luxury Holidays” (when deemed necessary) reserves the right to:


(1) Cancel any itinerary or any part of it,

(2)  Make any alterations to the itinerary (including, but not limited to, alterations to substitution of hotels).

(3) Decline to accept or to retain any person as a tour passenger should such person’s health, mental or physical condition, in our sole opinion, impede the operation of the tour of the other passengers. Tour members are held responsible for being in sufficient good health to undertake the tour. If a passenger is asked to leave while the tour is in progress, that person will be responsible for charges incurred on account of such departure from the tour and/or their return to their country. In such a case, “The Luxury Holidays” will refund any monies that possibly can be recovered for the unused portion of the tour, taking into account additional charges incurred by us. Other than to refund such sum, we shall accept no further liability or obligation toward that person or third party.

RESPONSIBLE TOURISM
Travel is one of the natural rights of all the people and is a crucial ingredient to world peace and oneness. Please respect the frailty of earth. One must realize that unless all are willing to help in the planet's preservation, unique and beautiful destinations mat not be there for our future generations to enjoy. Common sense and courtesy go a long way when you are traveling. Think about the impact you may be having on the environment and the people who inhabit it. One very simple way of minimizing your impact is to reduce the amount of plastic you use. Buy terracotta cups at train stations rather than the plastic ones; recycle plastic bags, drinking bottles or purify your water.

While taking a camel safari in desert areas of Rajasthan, pay particular care to how you dispose off your rubbish; safaris operating out of Jaisalmer have left an alarming trail of trash through the desert. The same applies when trekking or doing mountaineering.
